The fight in court over the Imo West Senatorial ticket has moved to the Court of Appeal, where Senator Osita Izunaso is testing the purview of the Federal High Court to mediate on the suit documented by Imo State representative, Rochas Okorocha, against the Independent National Electoral Commission (INEC) over his authentication of return.
Also, Izunaso, who is the third reacted in the suit, has requested that the appealing party court put aside the decision of Justice Okon Abang of the Abuja division of the court accepting locale to hear the case.
In the suit at the preliminary court, Okorocha, through his direction, Kehinde Ogunwumiju, (SAN), is looking for the request of the court convincing INEC to issue him with an endorsement of return as champ of the senatorial decision.
Interim, procedures for the situation have been suspended to anticipate the result of Izunaso's intrigue.
Equity Abang, who suspended further procedures in the issue before him, said he had gotten the affirmations of actualities documented by Izunaso, dated May 20, 2019, with respect to the pending intrigue.
In the notice of advance before the Abuja division of the Court of Appeal, dated May 13, 2019, Izunaso is requesting that the court put aside the decision of the Federal High Court on the issue of locale.
The intrigue, which is predicated on six grounds, is likewise testing the choice of the preliminary court to join the Peoples Democratic Party (PDP) as a respondent in the suit.
